Terms and Conditions of Temporary Holiday Accommodation at Kurreki (Holiday Rental Code of Conduct 2012)

 Note: Variances can be agreed on but only by arrangement with the Owner and must be in writing.

 1.1 General Content

i) Reservation Details 

ii) A 50% deposit is required to secure the booking. Payment of the rental deposit constitutes the clients acceptance of these Terms and Conditions.

iii) Balance of the rental amount must be cleared/received in full, 7 days prior to occupancy. If not the owner has the right to cancel the booking and attempt to re let it. 

iv) Cancellation if caused by the client, money paid is not refundable unless the house is re-let for the entire period. If a refund is made due to the property being relet then a $50 cancellation fee will apply. 

v) The owners will make every effort to ensure the property is available as booked. However the owners reserve the right to make alterations to bookings due to unforeseen circumstances.

 1.2 Licence not a Tenancy

i) Guests are granted limited permission to occupy the Property for holiday purposes.

ii) This is not a residential tenancy agreement under the residential tenancy legislation, and 

iii) Failure to comply with the Guest's obligations in these terms and Conditions may result in termination of permission to occupy the Property and eviction.

 1.3 Security Deposits or Bonds

i)The bond/security deposit is payable at the same time as the balance amount of the rental.

ii) The bond/security deposit will be refunded within 14 days, from the end of your stay, in full subject to a report from our cleaner and the conditions included in the terms and conditions being met. It is designed to cover any additional costs incurred including but not limited to, any breakage, damage or excess cleaning requirements, excess garbage removal, extra guests beyond those declared, etc. 

 

1.4 Maximum number of Guests and Visitors

i) Maximum number of permitted guests at Kurreki is 10 (including adults and children). Maximum number of permitted adult guests at Kurreki is 7.

ii) Number of Guests shall not exceed the number stated on the Confirmation Notice or subsequently agreed in writing or email.  Fees will apply for excess guests not agreed with the owners in advance.

iii) Maximum number of permitted guests and visitors at Kurreki shall not exceed 15 in total. A visitor is not permitted to stay overnight. Failure to comply with this condition will result in extra charges deducted from bond/security deposit and may result in eviction.

 

1.5 General obligations of Guests and Visitors

All Guests and Visitors must:

i) Comply with all House Rules, Terms and Conditions herein and By-Laws;

ii) Respect the residential amenity and security of the Porperty and neighbours;

iii) Refrain from anti-social behaviour;

iv) Guests must control and be responsible for Visitors and ensure that Visitors comply with the House Rules;

v) Comply with any instructions from the Owner during their stay; 

vi) Notify the Owner of any disputes or complaints as soon as practicable; and

vii) Guests and their Visitors use the Property - Kurreki, its environment and equipment at their own risk. Children should be adequately supervised at all times. The Owner is not liable for any accident or injury which may occur.

viii)All linen must be supplied by the Guests unless alternative arrangements are made. Linen shall be used on all occupied beds. If the cleaner or Owner has any reason to suspect that linen has not been used, charges will apply. This will be deleted from the Bond or Security Deposit.

viiii) Damage, Breakages, Theft and Loss are the Guests responsibility during their stay. Articles must not be taken out of the Property for picnics, functions etc.

 

1.6 Noise and Residential Amenity

i) Guests must not create noise which is offensive to neighbours especially between 10pm - 8am and during arrival and departure at any time throughout the occupancy.

ii) Offensive noise is prohibited and may result in:

a) termination of permission to occupy the Property;

b) eviction;

c) loss of rental paid; and

d) extra charges for security and other expenses which may be deducted from Security Deposits or Bonds.

iii) Guests must abide by any noise abatement conditions, standards or orders issued by police or any regulatory authority to minimise impacts upon the residential amenity of neighbours and the local community.

 

1.7 Functions and Parties

i) The Property is not a "party house" and any such activities are strictly prohibited; and

ii) Any gathering, celebration or entertainment permitted at the Property in writing by the Owner must not conflict with residential amenity and must comply with all House Rules.

iii) Weddings and Functions are strictly prohibited. The tarriff charged is for domestic use only and not commercial. Accordingly this rate does not allow for the extra wear associated with functions/parties, etc. in terms of cleaning, garbage removal, wear and tear, repairs etc. Use contrary to this will result in loss of your Bond or Security Deposit and/or additional payments. 

 

1.8 Access and Parking

i) Guests and Visitors must comply with parking regulations and show consideration to neighbours;

ii) Parking is not permitted on any planted areas either side of the hard stand area. Damage to vegetation will result in a claim against the Security Deposit or Bond to rectify planting.

 

1.9 Recycling and Garbage

i) Guests must dispose of garbage and recycling in the following manner. Put all non recyclable household rubbish in the bin with the RED LID and all recyclable items in the bin with the YELLOW LID. (see guide on bin lid) Please place bins at kerb on Thomas Road before you leave. Council gabage collection occurs early Wednesday morning. Bins must be placed at the kerb on Tuesday night. If the garbage pick up is missed because the bin has not been placed at the curb after the Guests stay, charges will be incurred for garbage removal. 

ii) Guests must not leave rubbish anywhere in the Property. Excessive amounts of rubbish left behind outside of peak periods may incur a claim against your Bond or Security Deposit.

iii) The bin with the GREEN LID is for green waste only. Any household rubbish disposed of in this bin will incur a claim on the Bond or Security Deposit.

iv) All kitchen waste should be deposited in the worm farm at the rear of the Property. Please do not put kitchen waste in the garbage bin under the sink - use the warm farm behind the house (instructions in the black folder). This helps the worm farm work properly and also discourages the small marsupials who like to come into the house looking for food.

 

1.10 Deck and balcony areas

The riding of skateboards, roller blades, scooters, bikes, etc. are not permitted on the deck areas.

 

1.11 Smoking

Smoking is not permitted indoors or in partially enclosed areas of the Property ie. hammock deck. Kurreki is a low allergen environment.If smoking occurs outdoors all butts must be disposed of in the garbage bin, not in any of the garden areas.

 

1.12 Pets

Pets are not permitted at Kurreki under any circumstances. If evidence of a pet/s is found extra cleaning charges will apply. Kurreki is a low allergen environment.

 

1.13 Cleaning and gutting Fish

Under no circumstances are fish to be cleaned and/or gutted anywhere on the Property

 

2.0 Complaints and dispute resolution procedure

i) Guests are obliged to report any probelms or incidents promptly to the Owner.

ii) The Owner will endeavour to have any repairs to appliances attended to as soon as possible after receiving report of same, however immediate repair may be beyond the owner's control due to material / labour availability.

Due to the relatively isolated nature of Seal Rocks, power outages occur more frequently than in urban areas. There is also poor mobile reception throughout Seal Rocks. While wifi is provided at Kurreki disruptions can be experienced. Television reception is not as reliable as in metropolitan areas and some channels are unavailable. All of these issues are beyond the control of the owners/managers. There will be no refunds or discounts deducted from tariffs for unusable appliances awaiting repair.

iii) Every attempt is made to supply the property with adequate and suitable crockery and utensils. Acrylic wine glasses are available at Kurreki (due to excessive breakages in the past and glass being left in the dishwasher). If it is important to you that you drink your wine from a glass receptacle please make arrangements so you may do so.

iv) All complaints or disputes must be lodged in writing to the owner before the Bond or Security Deposit or balance thereof is returned.

v) Guests will be advised of any claims made against the Bond or Security Deposit before same is returned.

 

2.1 Consequences of not meeting the Terms and Conditions

i) The consequences of not complying with the Terms and Conditions requirements can include enforcement action from the Owner, local councils or, in some instances, the Police.

ii) Enforcement action is subject to the Australian Consumer Law and other relevant legislation.

iii) Such enforcement action could result in termination of permission to occupy the Property, eviction, loss of rental paid, deductions from Security Deposits or Bond and extra charges.

d) It is therefore important for all Guests to be aware of their obligations and of their responsibilities to make any Visitors to the Property aware of these requirements to maintain the amenity of the Property and its neighbourhood.
